Abbey’s Motion to Dismiss Denied; Parry Case Moves Forward
 

On October 21, 2011 a judge in Nodaway County, Missouri dismissed Conception Abbey’s motion to dismiss a lawsuit brought against the Abbey by one of Fr. Bede Parry’s victims. (See text, below)

The ruling allows the attorneys from John Doe 181 to proceed with their lawsuit.

The Court’s October 21, 2011 Ruling:

Defendant Conception Abbey Inc. has moved this Court, pursuant to Missouri Supreme Court Rule 55.27(a) (6), to dismiss Plaintiff’s Petition for Damages for failure to state a claim upon which relief can be granted. The Defendant asserts that dismissal is required because the pleaded facts in the Petition establish that Plaintiff’ s cause of action is barred by the applicable statute of limitations. The Motion to Dismiss has been fully briefed and argued and the Defendants Motion to Dismiss is hereby denied.
